EU top court tells tribunal to re-assess EU approval of €3.4 billion Dutch aid to KLM
BRUSSELS, Nov 5 (Reuters) - Europe's top court on Thursday told a lower tribunal to re-assess the European Commission's approval of €3.4 billion ($3.8 billion) in state aid granted by the Netherlands to Air France-KLM's AIRF.PA Dutch unit in 2020 in the midst of the COVID pandemic.
A lower tribunal had in 2021 and 2024 backed Ryanair's RYA.I challenges against the aid, prompting the Commission to appeal to the Luxembourg-based Court of Justice of the European Union (CJEU).
"The Court sets aside the General Court's judgment by which the Commission's approval of €3.4 billion in State aid granted by the Netherlands to KLM had been annulled," the CJEU said, adding it was now referring the case back to the General Court.
