(hereinafter referred to as “the Conditions”)
1.1. These Conditions outline the procedures for the Campaign titled "Refer-A-Friend" (hereinafter referred to as the "Campaign").
1.2. These Conditions replace and supersede any previous terms and conditions of the Campaign «Refer-A-Friend» (the “Previous Conditions”) in their entirety.
1.3. The entity organizing the Campaign is Capital Com Online Investments Ltd. (hereinafter referred to as the "Firm"), a company registered in The Bahamas under registration number 209236B, with its registered address at #3 Bayside Executive Park, West Bay Street & Blake Road, P.O. Box CB-13012, Nassau, Bahamas. The Firm is authorized by the Securities Commission of The Bahamas ("SCB") as a Registered Firm authorized to conduct Securities Business under license number SIA/F245.
1.4. Participants in the Campaign are subject to the Firm’s terms and conditions (hereinafter - the “Firm’s Terms and Conditions”) and supplementing policies, including without limitation, Risk Disclosure Statement, Order Execution Policy, Conflict of Interests Policy, Complaints Policy, Cookies Policy and Privacy Policy (hereinafter – the “Firm's Policies”), which can be found on the Firm's website at https://capital.com/en-int/terms-and-policies.
1.5. All the terms not defined in these Conditions shall have the meanings ascribed to them in the Firm's Terms and Conditions.
1.6. BY PARTICIPATING IN THE CAMPAIGN, PARTICIPANTS ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO ABIDE BY THESE CONDITIONS.
2.1. In order to take part in the Campaign, a person must satisfy all of the following requirements:
2.2. The Firm shall have the right to disqualify any person from participating in the Campaign, if there is a ground to suspect that they have opened an Account with the sole purpose of receiving the Rewards, e.g. if any person claims a Reward within 30 days (or any longer period as may be determined by the Firm) from the date of opening their Account and/or has no executed trades in their Account before claiming a Reward, etc.
3.1. The Campaign will commence on the 13th of November 2025 and conclude on the 31st of October 2026 inclusive (the “Campaign Period”). The commencement and end dates of the Campaign shall be published on the Firm’s website and in the Terms and Conditions.
3.2. The Firm may, at its discretion and where applicable, subject to prior regulatory approval from the SCB, determine the general period of the Campaign.
3.3. The Firm may, subject to prior regulatory approval from the SCB, extend the Campaign Period at any time; provided that, without prior regulatory approval, the Campaign shall operate for no more than twelve (12) months.
3.4. The Firm’s previous right to modify the Campaign at its sole and absolute discretion is hereby removed. Any amendment, suspension or termination of the Campaign shall be subject to the prior approval of the SCB.
3.5. This phase of the Campaign shall not operate concurrently with any other phase of the Campaign.
4.1. Existing clients of the Firm (hereinafter – the “Referrers”) can engage in the Campaign by recommending the CAPITAL.COM Online Trading Platform to their friends and/or family members (hereinafter – the “Referees”).
4.2. In order for the Referrer and the Referee to qualify for the bonus (hereinafter – the “Reward”), the Referee must fulfil the following actions on the CAPITAL.COM Online Trading Platform (hereinafter – the “Eligibility Criteria”):
(i) Open a new Account with the Firm;
(ii) Complete Account Opening and Customer Verification procedures established by the Firm;
(iii) Deposit a minimum amount between USD 50.00 to USD 500.00 or equivalent in another supported currency into their Account, as determined by the Firm and disclosed to the participants on the Firm’s web platform, mobile app, or via marketing communications;
(iv) Execute between one to three trades (as determined by the Firm and disclosed to the participants on the Firm’s web platform, mobile app, or via marketing communications) on the CAPITAL.COM Online Trading Platform within three months of their Account being activated (hereinafter – the “Qualifying Period”); and
(v) Fulfil any additional eligibility criteria set forth by the Firm and disclosed to the participants on the Firm’s web platform, mobile app, or via marketing communications.
4.3. Additionally, the Referees must:
(i) Acknowledge and consent to the contents of the Firm’s Terms and Conditions and the Firm's Policies by ticking the corresponding box during the account opening process when providing personal and contact data on the CAPITAL.COM Online Trading Platform.
(ii) Access the latest mobile and web application versions of the CAPITAL.COM Online Trading Platform.
4.4. The Firm may in its discretion update the Eligibility Criteria of this Campaign by updating these Conditions or marketing communications (including without limitation, emails, push-ups, inbox).
4.5. The Referrer must ensure that the Referee uses their unique referral link and/or referral code (where applicable) during the account opening procedure for tracking purposes.
4.6. The Referrer must neither assist the Referee in completing the account opening process on the CAPITAL.COM Online Trading Platform or provide any advice to the Referee on the use of the financial services of the Firm.
4.7. The Firm will determine whether the Referrer and the Referee are eligible for the referral bonus based on the requirements specified in Sections 2 and 4 hereof and may reject an application of any participants if there is any ground to suspect that their participation in the Campaign is unfair, deceptive and/or abusive of these Conditions.
5.1. Both the Referrer and the Referee who satisfy the requirements specified in the Sections 2 and 4 herein shall be entitled to receive a cash bonus of up to USD 500.00 or currency equivalent (hereinafter - the “Reward”).
5.2. The Referrers can receive up to USD 500.00 for each referred Referee. The exact amount and applicable tiers of the Reward will be determined by the Firm in its sole discretion and communicated to the participants on the Firm’s web platform or mobile app, or via marketing communications.
5.3. A Referrer/Referee can manually claim a bonus within the Firm’s web platform or mobile app, once the Referee fulfils the Eligibility Criteria outlined in Sections 4.2. of these Conditions. If the Referrer/Referee opts not to claim the bonus manually, it will be automatically disbursed into the Eligible Client`s Account after the Eligibility Criteria is met. If the bonus is not distributed automatically, please contact the Support centre on the Trading Platform to address the issue and claim the bonus.
5.4. The Firm may, at its discretion, implement a randomised bonus model under which the Referrer and/or Referee will receive a variable bonus amount, randomly selected from a pre-defined range of values up to USD 500.00. The range and distribution of potential bonus amounts shall be predetermined and disclosed on the Firm’s web platform or mobile app, or via marketing communications, and the results will be final and binding.
5.5. The Rewards are personal, non-transferable, and may not be sold, exchanged, or assigned.
6.1. The Referrer and Referee must both be residents of jurisdictions where the Firm is permitted to offer its services under the authorisation and regulation of the Securities Commission of The Bahamas (SCB).
6.2. The Campaign will exclusively operate in USD. If a Referrer/Referee holds an account in a different currency, the payout of the referral bonus will be converted accordingly using a reasonable exchange rate on the day of payment.
6.3. Referrers are allowed to refer an unlimited number of friends/family members, unless otherwise specified on the Firm’s web platform, mobile app, or via marketing communications.
6.4. If any tax is payable on the Rewards, this tax will be the Referrer/Referee`s liability and will not be incurred by the Firm. If the law requires the Firm to withhold this tax and settle with the relevant tax authority on the Referrer/Referee`s behalf, then the Firm shall credit the Reward to the Referrer/Referee`s Account net of this tax.
7.1. When offered by the Firm (and disclosed to the participants on the Firm’s web platform or mobile app, or via marketing communications), the Referees are entitled to rebates of their trading expenses determined by reference to the value of Spreads paid by them on their Account during the Qualifying Period of three months of their Account being activated. The rebates will be calculated as follows:
● Tier 1: If the Referee completes at least 5 trades in their Account during the Qualifying Period, the Referee`s rebate will be 20% of the Spreads paid, unless the rebate is calculated in line with the Tiers 2 to 4 below;
● Tier 2: If the Referee pays Spreads on their Account during the Qualifying Period in the amount of at least USD 250.00, the Referee`s rebate will be up to 20% of the Spreads paid; and
● Tier 3: If the Referee pays Spreads on their Account during the Qualifying Period in the amount of at least USD 500.00, the Referee`s rebate will be up to 20% of the Spreads paid; and
● Tier 4: If the Referee pays Spreads on their Account during the Qualifying Period in the amount of at least USD 5,000.00, the Referee`s rebate will be up to 20% of the Spreads paid.
7.2. The Rebates under this clause 7 are not cumulative and no Referee will receive a rebate greater than USD 1,000.00. The Referees will receive their rebates upon the end of the Qualifying Period.
7.3. During the Campaign Period, the Referees may also receive monetary or non-monetary incentives ranging in value from USD 5.00 to USD 500, contingent on the Eligibility Criteria. The exact incentive amounts within the aforementioned range will be determined by the Firm and disclosed to the participants on the Firm’s web platform, mobile app, or via marketing communications. The Referee can only receive up to USD 500.00 total bonus under this Campaign.
7.4. The Firm will determine whether a Referee is eligible for the rebate based on the eligibility requirements specified in Section 4 hereof and may withhold (cancel) any rebate if there is any ground to suspect that the Referee`s participation in the Campaign is unfair, deceptive and/or abusive of these Conditions.
8.1. The Firm reserves the right to verify the participants' eligibility and disqualify any individual found to be violating or abusing these Conditions. Abuse of these Conditions shall mean any action taken by a participant that, at the sole and absolute discretion of the Firm, does not have reasonable meaning, contradicts the objectives of the Campaign, is fraudulent and/or entails receipt of unreasonable benefits based primarily on the technical and/or organisational features of the Campaign or the CAPITAL.COM Online Trading Platform.
8.2. The participants may share their referral links privately, but may not advertise or promote the Campaign and/or the financial services provided by the Firm publicly or commercially in any manner for the purpose of receiving the Rewards.
8.3. The Referrer acknowledges that their Referees will be informed that the Referrer will receive or have received a Reward as a result of opening and trading on the Referee`s Account.
8.4. The Referee acknowledges and agrees that the amount of Spreads that they have paid may be disclosed to the Referrer in order to calculate the Referrer`s Reward.
8.5. The participants acknowledge that this Campaign is not an inducement to trade, and they take part in the Campaign at their own discretion and of their own volition, understanding that trading leveraged products involves a high level of risk and may result in the loss of all of the client’s invested capital.
8.6. By participating in the Campaign, the participants agree to release and hold harmless the Firm, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, damages, or liabilities arising from or related to participation in the Campaign.
8.7. Participation in the Campaign constitutes acceptance of these Conditions and any decisions made by the Firm, which are final and binding on all parties concerned.
8.8. The Firm reserves the right to terminate, suspend, or modify the Campaign or these Conditions at any time without any prior notice to the participants, provided that any amendment, suspension or termination of the Campaign shall be subject to the prior approval of the SCB.
9.1. The Campaign and these Conditions shall be governed by and construed in accordance with the laws of The Bahamas.
9.2. Any dispute arising out of or in connection with this Campaign shall be subject to the exclusive jurisdiction of the courts of The Bahamas.
9.3. Participants may raise any concerns in accordance with the Firm’s Terms and Policies prior to initiating legal proceedings.
